I am no stranger on the trading section of this forum. I have dealt with a large number of members since 2007 and before here I was doing commerce on World call and WCCFtech forums, I was there when the trader rep system was first implemented and have been around the ages of many members come and gone. But in ALL my years of trading and work I have NEVER had such a disgusting deal as I did with Devilishplayer.

Here is the story as brief as possible

I had 15k and needed a laptop he was selling a Toshiba Satellite A135 - S2246 (here is the thread link: http://www.pakgamers.com/forums/f64/mics-gadgets-cool-stuff-sale-151592/ item number 10) now he DOES mention the keyboard / touch pad not working and I make a deal with him of 11k for the laptop + keyboard / mouse combo.

I went to his office and I saw the laptop, now here were my original observations

- good condition
- running good (he had installed windows 7 on it but it was barren, only had GPU / WiFi drivers) no firefox, no flash / java / videos etc
- as I gave the money I told him I want a couple of days to test out the system for myself, he agreed

I went to hafeez center and got a new battery from a guy I bought a few batteries before, he has sold me genuine batteries for HP's and dells that I am still using just fine.

now I come home, charge new battery and begin using it, leaving Ninite downloading applications like Firefox, Java, Flash, etc (i.e all essential web browsing softwares) and I left laptop downloading and installing all that stuff, here's what followed:

- 3 tabs of firefox would make this system CRY. I have an HP 540 I bought this laptop the day Core 2 Duo laptops were viral in the market, while the Toshiba was C2D it had the performance of a LOW END P2! I could LITERALLY open 30 tabs on FF in my HP before I noticed MINOR STUTTERING , but the Toshiba was at my mercy WITH 3 TABS! and let me tell you what each tab had open; NeoGaf forums, a Wp-Admin page and grooveshark. (YES I am a DAREDEVIL opening SO MANY demanding applications AT ONCE!)

- and then I noticed that the battery isn't telling me how much is left -___- upon investigation I find out that the board doesn't have an ACPI or something which is responsible for this function. I say okay and get a widget for windows 7, this is tolerable for me but its still a nuisance.

-The battery lasted me a MERE 1 HOUR ON THE DIMMEST SETTING! I had set the brightness to 20 and it still gave me an hour and 10 minutes. This is the straw that broke the camel's back and made me furious.

I texted him on the second day as promised and tell him ALL THE ISSUES. he refuses to accept fault and insists I messed with it (Yes, silly me. Installing ALL that bloatware of drivers, a single widget for telling me battery time, firefox, java, flash. Yes I am simply the die hard bloatware user!)

Now lets get to the FUN PART:

- I Stupidly made my presentation on this with my group on this laptop, which is due tomorrow (thursday 13th dec 2012) and upon the noble advice of devilish player I had to drain the battery to 0% completely and leave laptop on overnight charge to prolong my battery life. I say what the heck and do it.

I do so and remember I had an urgent file to transfer before I slept, I powered on the laptop to find out the BIOS is asking me for a password. This is where I rage and lose it. I rush to my other laptop and google the issue, I spent 3 hours booting the laptop on / off trying EVERY BACK DOOR PASSWORD ON THE INTERNET (you have tries to enter a pass after which the system shuts down and I have to wait around a minute for the bios pass screen to come up again) ALL OF WHICH CAME TO NO AVAIL!

This all happened on saturday, 8th dec. I text the guy and he tells me to do a home repair job -__- THATS IT?! HE ASKS ME IF I CAN TAKE APART THE KEYBOARD AND MOUSE!? (and yes I know someone WILL POST THIS but as soon as I could I went into the BIOS and made the user / master passwords blank, i.e went to them and pressed enter as they were blank meaning NO PASSWORD!)

I am so pissed at this guys attitude, he first sells me a shitty laptop with the performance that would make a P4 look like an i7 X series processor even though my HP with the ALMOST THE SAME SPECS (it has a bigger HDD, that's IT! otherwise both CPU's are 65nm with 2GB DDR2) the battery life is even shittier and now I am LOCKED OUT OF THE LAPTOP WHICH HAS 3 HOURS OF MY PRESENTATION GONE TO WASTE not to mention I had to spend all day in university REGATHERING MY GROUPS INFO AND HAVE TO BURN THE MIDNIGHT OIL now to be done by 3AM.

I am literally being patient and neutral with the guy, but soon he took advantage and straight away said he will not refund. This set off my fuse that this guy should have MENTIONED ALL THE FAULTS! Anyone and everyone who has dealt / traded / bought / sold or otherwise met me in person KNOWS I am a very understanding / cooperative guy. I have NEVER had a sour deal on ANY of the forums and this deal has left a horrible taste in my mouth, I am ashamed of this man, I am younger than him and have the decency to admit where I am wrong but this SAVAGE insists that he is a genius and I messed up a laptop.

I have learned a lesson in dealing with these disgusting creatures now and taking advantage of my good faith. I am now taking him to consumer court and I am going to ensure that I get on his nerves as much as he got on mine. I am shocked that someone like him could do such despicable things, he looked like an adult but his actions were that of a spoiled brat who still leeches off his parents.


Now I know I am at fault and Jshak is right to point out that I needed a mediator and he jshak has really helped me at times when it was my fault, jshak has offered me to take this matter to NR3C and he will help me provide the evidences what NR3C requires, i am still at my consulting end what to do ( thanks jshak as always ), I never thought the need would arise but it seems that gutter trash like him might become more common. I am looking forward to pursuing the legal proceedings against him even if it means missing a few classes here and there. I am updating his threads with a link to his threads so he doesn't have the pleasure of ripping off other PG members.

I hope this guy gets whats coming to him as his actions have truly shocked me to the core.

I have currently given the laptop to a guy in HC who came with a lot of praise from all my laptop veteran buddies and he was taking 1000 for a job others were taking 3000-3500 for (The BIOS Password removal) and I gave him the laptop today.

This deal ended up costing me more than I originally intended. so beware of this guy, don't be foolish and make a deal with him, if you have already done so I HIGHLY recommend you cancel it IMMEDIATELY!

TBH the only real issue I see here is the BIOS password which the seller should have informed you about. The laptop itself looks like a piece of junk from the 80s which might explain the performance issue. It could be that near-death hard drive or dust build up inside.

I never really opened it, the CMOS thing is pretty easy to reach but its soldered on. My real shock is HIS ATTITUDE UPON FINDING OUT THE BIOS PASSWORD -__- he blamed me. I may not have your or HMS1193's level of hardware knowledge BUT I AM NOT AN UTTER IDIOT EITHER. This guy is just trying to make a quick buck. I am adding the password removal costs to my recovery costs.

Thats not truth, i know he is trying to sympathies from all members. I never Gave him any kind of warranty, and told him alot of times that its a used laptop , Which i gave him Only for 9000. 11K including the New Keyboard and mouse. he never checked thoroughly which i asked him to do, But he was in so much hurry that he checked only few things and left.
If you( the buyer) are reading this did I gave you any kind of Warranty. IF So plz prove it before calling me fraud. didnt i cleared each and everything to you ? if you can prove these things then come to me again and get your money. I'll not get rich with your ***** 9K.

A laptop of that specification should run smoothly. Is the OS on that laptop completely new? If it is, check the temperatures of the processor using HWMonitor.

BTW, I don't see the seller at fault here. The laptop seems to be slow. But he wouldn't have control over it. The issue was of battery, keyboard, mouse and he mentioned it to you at that time and compensated it too.

The part where he is at fault is saying that you messed up the laptop. I don't see anyone at fault here. It could be overheating issue (due to Laptop not being used for a long time leading to dust buildup), or software issue (Windows loaded with tons of bloatware). He could not have mentioned the battery timer checker thingy or that BIOS password thingy as they depend on research on your part.

And this is where our convo ended. Where did you mention the free removal? you ended with asking ME to remove the HDD ... I have the threads on my phone and everyone knows threads can't be manipulated.

And please, I am getting pity of members? I have spent YEARS on this forum building up my reputation. EVERYONE here knows my character, meet every single person I have dealt with even the high tier people like SEevolution, Amaga, lordscar, etc I have dealt with MANY pg members in my span over here and 114 trades are only a place holder, I have been dealing in this stuff since I was 13 and world call had just come to Pakistan. Even then I knew how to do business respectfully.

And I remember VERY well that I told you my brother is coming to pick me up? How the hell am I supposed to check a BARREN LAPTOP? I mean you had no videos, no proper utilities like Java / Flash etc nothing on the HDD or the OS except for vga / wifi drivers, do you expect me to download ALL the stuff i needed to test it there and then? bhai it took me a good 2 hours on my 4 mbit to install all the stuff i needed like firefox, chrome, flash, java on my 4 mbit. at least admit you gave me a barebone laptop with NOTHING on the OS to test with?

and I was walking to the door and said "I will use it for a couple of days and let you know?" and you said "no problem" and even if you didn't it is my right to claim warranty if the performance isn't up to par with my expectations isn't it? I had expected the keyboard / touchpad / battery issue but I could not forsee the CRAP performance of the laptop overall.

I don't need the "sympathy" of these people, these people are my friends, gamer bud's and many of them have known me FOR YEARS. Manigamer, HMS1193 and many other forum members have known me for YEARS now and know what kind of a person I am. My posts and history on this forum is enough evidence that I have done my fair share of dealings with people in and out of lahore.

and OLD LAPTOP?! I will bring my HP540 to your office and we can do a side by side test. Which ever one loads the OS the fastest, which can open more tabs etc and compare you the same specs, my HP540 is also a C2D 2.0 ghz 65nm with 2GB ddr2. Yours is 1.8 Ghz with 2GB DDR2.

Is the Laptop on power saver mode (noob question but still asking). Because the specs are decent enough as I wrote earlier. It should work fine if windows install is new. Heck I recently reinstalled windows 7 on my atom netbook (with 1 GB RAM) and even 6+ tabs on Chrome are easily workable. :s

I feel sorry for everyone believe me. But I don't understand why a laptop of such decent specifications can work so poorly.

- CPU throttling due to thermal issues caused by dust build

and/or

- Dying hard drive.

Either way it's difficult to believe that the seller didn't know about it.

Do you think whatever you are writing is right??, you said i'll let you know about the problems in couple of dayz and yes i did said NP. But this doesnt mean that i gave you a warranty, i said in a context of that i'll help you out. And my post clearly says NO WARRANTY AT ALL. you were txting me finding out the details n stuff for DAYS did i mentioned once about the warranty, and always told you, its old laptop.
And as i remember i told you that the BIOS upgrade caused the problem of keyboard and pad, didnt I.
So Be VERY CAREFUL before calling me a fruad again. and dont act like a Victim.
try to be relax, send me you laotop and letme figure out what is the real problem. and Again BIOS password is only caused with Bios upgrade from Toshiba website.

on the 2nd day when I told him the issue and he jumped to "NO REPLACEMENT / REFUND" part thats where I stopped texting him and saw a lost cause. anyone knows that I am a good patient guy but I hated how this guy took advantage of it

currently I have given the laptop for BIOS password removal to a friends repair guy who has told me the following WITH PROOF, including opening the laptop in the lab in front of me

- the OP had shorted out the jumpers before. yet he failed to mention the chance of a BIOS password issue and like I mentioned earlier at NO point did he even bother to help me or offer me assistance. his opening / ending statements always were, no money, no return or its an old laptop etc. NEVER did he ever say to bring the laptop to him.

- the BIOS password is in the loop now, because apparently without the keyboard (the default keyboard) the laptop boots fine, but once you put the keyboard back on the problem of BIOS password comes again. Now the guy is further saying that the keyboard connector or something will need a fix and this will probably bring the keyboard back to life.

I am just ashamed of this guys practices of how he took advantage of my silence and patience and now he isn't able to face his own consequences.

Currently I am engaged in a LOT of work at uni and hence haven't had time to sign the legal notice, I will take time over the weekend and sign it. this is the first time my deal has EVER gone this sour and now I know how to be more careful than I already am in the future.

Currently I have spent

11k (keyboard + mouse included) + 2200 for the battery + 1500 for this battery = 14,700. I only have 300 left for the entire month now where I was previously expecting more. I earn my money no matter how meager it may seem to you and for me to go through loss after loss is UNACCEPTABLE!

I can honestly say that this laptop has spent more time in my bag than it has outside because of the poor performance / battery issue that I see no point in even using it, now tomorrow I'll get a replacement battery and see if that fixes the back up time and maybe the performance too but the laptop repair guy is doing internal cleaning for free too which is great.

Its a SHAME that I had to get these services from a 3rd party where as it was the duty of the seller to ensure he is selling a PROPER working product before even making a thread.

If full refund is being given, I'd take it and not waste my time anymore.

what refund offer ... as far as I have seen he hasn't offered me any money back. and if I am going to take a "refund" i am going to adjust all the stuff like new battery, repairs etc and khawari he put me through. he doesn't like it, its fine by me. either way I am going through the suit.

I won't even dignify that question with a response =/ OF COURSE I TRIED IT ON ALL SETTINGS MAN! =/. and even I was shocked. I installed fresh windows 7 and 8 and both are running like crap. lets see if the laptop gets any better when I get it back tomorrow.
